Dear Ms. Wan :

United Lot Owners of Cambria is very concerned about the finding of substantial issue with the application for a Minor Use Permit in Cambria by Steven and Sue Monaco.  The finding shocked us all, as the commission staff had recommended a no substantial issue finding.

The facts in this case are pretty simple and straightforward.  The law requires that an applicant have an intent letter from the local water district to qualify for a building permit.  This applicant has one that is still valid and honored by the water district.  That should be the end of the discussion as for as the Coastal Commission is concerned.

The appellant in this case asks the Coastal Commission to do more than just follow the law.  He asks the Coastal Commission to overrule the local water district on its decision that it has sufficient resources to honor it's own intent letter.  In our opinion, that takes the Coastal Commission beyond its boundaries.  The water district has already done extensive studies to determine the extent of its resources, and commission staff has found no fault with the studies.
